Car Accident Law in Texas

In 2020, according to data from the Texas Department of Transportation, 1 reportable crash occurred every 1 minute and 7 seconds on Texas roads; 1 person was injured every 2 minutes and 34 seconds, and 1 person was killed every 2 hours and 15 minutes.

Texas is an at-fault state which means that the person responsible for an accident is liable for paying for damages they caused.

Texas law allows injured accident victims to sue the liable parties involved to recoup their losses. "Damages" may include property damage and bodily injuries.

Minimum Insurance Requirements in Texas

Under Texas law, motorists are required to maintain a minimum liability insurance policy in case they cause an accident. As of 2023, those minimums are:

  • up to $25,000 for Property Damage
  • up to $30,000 for Bodily Injury, per person
  • a maximum cap of $60,000 for all Bodily Injury payouts, per accident

Insurance companies may list policy limits in this format on insurance cards or other documents:

  • 30/60/25
  • $30K / $60K BI, $25K PD
  • $25K, $30K/60K

Why is Liability Insurance Important?

The purpose of liability insurance is to protect your personal assets from financial liability.

So, if you are sued by someone for causing an accident, your insurance company will represent you or pay for damages up to the policy limits you purchased instead of you paying out of pocket for the damages you caused.

Without collision coverage, your car won't be fixed or replaced. No PIP or UM/UIM means you could be paying out of pocket for any treatment costs you incurred in addition to any lost time from work.

Collision will help pay for your property damage or a possible replacement if your car has been totaled. PIP will pay out regardless of who is at fault, and Uninsured/Under-Insured Motorist coverage will pay if the at-fault driver was not insured or their policy limits were not enough to cover your bodily injuries.

How long does it take for injuries to appear after a car accident?

Many symptoms and injuries can start to appear almost immediately after a collision. You may need immediate medical attention if you experience any of the following symptoms:

  • Chest pain that endures for at least two minutes
  • Shortness of breath or trouble breathing
  • Severe or sudden pain
  • Sudden weakness or dizziness
  • Sudden change in vision
  • Uncontrolled bleeding
